I think my one and only cease and desist in like 10 years on eBay was from New Era and Red Bull GMBH...can't resell their player exclusive gear because it was never meant for sale. My only issue with that, is that I indeed bought it at a thrift store, making it mine and mine to resell. They aren't sending cease and desists to Salvation Army (as far as I know, they probably have though), so why me? I didn't get it off a sponsored athlete and I didn't get it from a Redbull employee. Not losing my eBay account though, so, Redbull, New Era and anyone else that wants receipts that I can't produce, can all get left in a landfill for all I care.

I don't like eBay for one there's a lot of scams out there on eBay too when you order something and you buy it with your card they do not send it half the time God bless Commonwealth

I have only had a one recall item ever removed. It was also a manufacture recalled item. As in your case, there were dozens still listed on eBay and many more that had sold. As a test, I reported a few of the ones listed as being an item that has been recalled. eBay later responded they investigated and determined the item was fine. It made no sense as it was the exact item. 🤷‍♂ 🙄 Twice this week I've received messages from eBay about items being pulled due to them being past the expiration date. I used to sell a lot of supplements, but for now I only have a few left. I did not recognize the items they said they removed and I could not find any trace of them being listed. After some additional digging around through my records, I discovered these were items that had sold over a year ago, and well before their expiration date. I have no idea why their bot choose to send me messages about these items.

I quit feebay when they made u pay to get your payments for your items thru PayPal. Feebly sucks😢

I'm a professional vendor on eBay averaging $25,000 a month and I have completely stopped using FedEx because of these crazy upcharges that he talks about. If you enter the correct size and weight, they will usually claim that it's always more and charge you more money. The UPS or USPS very rarely do this. In fact I don't think that the USPS has ever done this to me in thousands of sales.

Anyone calling someone “dumb” is generally jealous of that persons success and a miserable human. Just a thought.

This may be off topic, but I need advice ASAP. I sold an item to someone who created their Ebay account the same day of the sale. They have no buys or any feedback. I just have a bad feeling. Should I just send the item and hope fur the best or cancel. Am I just being paranoid?

We had 4 items that were taken down last month for not following safety reasons. They were brand new in the package baby seat head rest inserts for car seats. We disposed of them, I did not want anyone having any trouble with an item like that. Also, we received our very first Neutral!! We sold NEW sleep shirts, as described in photos & description. Well it states that they are "Good enough to wear around the house." We asked for a revision, kindly. But, we are a little put off because we combined shipping & would have happily done a return. What's a seller to do??

You cannot sell recalled items wether they are class one two or three. They are automatically blocked scu numbers at most retail establishments to prevent an accidental sale. That is really the point . They want all the “dangerous” items returned so no one gets injured in any way . 😊

Unfortunately eBay has in their terms of use the right to refuse and remove listings for anything they wish. They are not required legally to sell your item on their platform. But yes lots of brands have automatic search engines find items they represent, they file for removal, and eBay rolls over citing that they do not wish to be a party to anything that could possibly be involved in legal violations. They don’t allow appeal without you having the burden of proof on its legal legitimacy. They have zero standing against you. They also just can step out of being involved at all (which they commonly do).

Then anybody who uses AI I have to worry that the info they give me via using AI, if its correct. Thus making me have to question the accuracy of it. Maybe it will get better but right now it's more work.

This is just corporate intimidation under the guise of a legal complaint. If this did result in litigation, you would have a dozen nonprofit organizations willing to help you fight this battle. So yes legally you have the right to sell these items under first sale doctrine. Secondly you are under no obligation to comply with a C&D letter. Finally however a platform you list things on generally will have clauses in their contract and terms allowing them to remove things at their will. You can however have a lawyer take action stating your rights, however they are also not required to comply, nor are they required to change their minds. BTW Federal Trademark protection is against a mark (logo) for branding in business doesn’t protect against the use of something as a description. So I can call something based on what it is under the fair use doctrine of trademark (i.e. a Nintendo switch is manufactured by Nintendo, so identifying it as such is a matter of fact and not trademarkable. If you proclaimed you were Nintendo that is a trademark infringement). Copyright law applies to reproduction of works of art in total or part. You are not reproducing an item that is copyright someone else so it doesn’t apply if these are authentic merchandise being resold.

Cease and desist letters are not court orders. Counter them and if a lot of us do it their legal costs will put them out of business.
